We want every tree, shrub and yard we touch to thrive. To keep things clear and fair, here's how responsibility works when you buy from Go-Lush Green. Please read this before you approve your quote. By signing a Go-Lush Green quote, you agree to these terms along with our Refund Policy and Terms of Service.
Who supplies and installs your order
Go-Lush Green is a nursery and landscape distributor. We quote your project, take your order and coordinate everything for you, but we do not grow plants, carry inventory, or run our own planting crews. Trees, plants, sod, stone, mulch, soil and other materials come directly from independent licensed growers, nurseries and material yards, and planting and installation are performed by those suppliers or their crews.
Because of that, the supplier that grows, delivers or installs your product is responsible for that product and for its delivery and installation work. Any warranty or guarantee on your plants, sod, materials or installation is the supplier's warranty, passed through to you, and is subject to that supplier's terms. We'll tell you what coverage applies to your order before you sign, and we'll handle any claim with the supplier for you. Go-Lush Green does not add its own warranty on top of the supplier's.
Plant and tree coverage
- Coverage, when offered, usually applies only to trees and plants that the supplier's crew planted. Plants you plant yourself, and larger trees moved or replanted by anyone else, are generally not covered.
- Coverage depends on proper care after planting, including following the watering schedule you're given. Over- or under-watering, broken or missing irrigation, and skipped care can void it.
- Freezes, extreme heat, drought, hail, high wind, flooding, lightning, animals, insects, disease, vehicles, other accidents and other acts of nature are not covered unless you buy a separate protection plan that specifically covers them.
- A covered claim means a replacement plant of similar size and type, not a refund. Replacement is typically limited to one per plant.
- Annuals, perennials, sod, seed, bulk soil, mulch, rock and other materials carry no plant warranty.
- Dead or damaged on arrival: as stated in our Refund Policy, report it within 48 hours of delivery with photos and we'll get the plant replaced.
Sod and grass
Sod is a living product and is cut fresh for your order. Once it's delivered, its survival depends on prompt installation, soil prep and the watering schedule. Sod is not warrantied and cannot be returned.
Natural variation
Trees and plants are living things, and stone, mulch and soil are natural materials. Size, shape, fullness, color, texture and leaf or bloom may differ from photos, samples and other plants of the same variety, and from one load to the next. Photos on our site are for reference only. Dyed mulch fades, and mulch and soil are heavier when wet. Natural variation is not a defect.
Delivery and site access
- Delivery dates are estimates, and weather or site conditions may require rescheduling.
- You're responsible for clear, safe access for large trucks and equipment. Tell us in advance about narrow gates, soft ground, low branches, overhead lines, slopes or other obstacles.
- Heavy trucks and equipment can leave ruts or marks and can crack driveways, curbs, sidewalks, pavers and new concrete or asphalt. Damage beyond the curb or delivery drop point caused by delivery or equipment you requested is your responsibility. If you're worried about a surface, ask for a street-side drop.
- If no one will be home, tell us exactly where to place the delivery. Placement you approve in advance is final.
Installation and your property
- Before any digging, underground utility lines must be located through Texas 811. Private lines, such as irrigation, low-voltage lighting, pool lines, septic and gas lines to outbuildings, are not marked by 811. Tell us where they are, because we and our suppliers are not responsible for damage to unmarked private lines.
- Mark where you want each tree or plant before the crew arrives, and keep plantings a safe distance from overhead and underground lines, foundations and structures.
- Results depend on existing soil, drainage, sun exposure and irrigation, which are outside our control.
Returns, cancellations and claims
- All sales are final once your signed quote is approved, per our Refund Policy. Delivered plants, sod and bulk materials cannot be returned.
- Changes or cancellations after your order is placed with the supplier may involve restocking, delivery or cancellation fees charged by the supplier.
- Report wrong, short or damaged deliveries within 48 hours, with photos, to sales@go-lushgreen.com or by text to (940) 360-3750, so we can file the claim with the supplier in time.
Limits of our responsibility
To the fullest extent the law allows, Go-Lush Green's responsibility for any order is limited to coordinating your order and any supplier claim, and in no case is more than the amount you paid us for the affected item or service. We are not liable for indirect, incidental or consequential damages, or for the products, delivery, installation work or warranty decisions of the independent suppliers who fulfill your order. Nothing here limits any rights you have that cannot be waived under Texas law.
